On Cisco's fourth quarter earnings call earlier this month, Chairman and CEO John Chambers said Cisco was charting a course toward "the next Cisco" -- a leaner company, simpler to do business with and more focused on key technology priorities instead of 30 or more distracting "adjacencies."

Based on all that's happened to Cisco in the past eight months and CRN's ongoing interviews with Cisco observers, here's a look at 10 big questions for the networking titan as its employees, channel partners and customers charge into Cisco's fiscal 2012.

Has Cisco Turned The Corner?

The first question, and the most obvious, concerns Cisco's growth, especially as it lays off 6,500 employees as part of a workforce reduction that'll leave Cisco well north of 12,000 jobs lighter.

Cisco took an expected profit loss during its fourth quarter of 2011, but there were a number of signs that Cisco is beginning to stabilize as it continues a broad corporate restructuring expected to remove $1 billion in expenses during its fiscal year. Specifically, said Chambers, Cisco will be a "very focused, agile, lean and aggressive company," and expects to grow revenue between 1 percent and 4 percent in the first quarter.

Cisco COO Gary Moore offered another stat that bears watching for partners. Moore said that thanks to Cisco's restructuring, deal approval time has been reduced by more than 65 percent, which was also translating to higher conversion rates and higher win rates for Cisco. It'll take a few quarters to determine whether all of Cisco's cuts mean a simpler, smoother Cisco.

How Will Cisco Defend The Crown?

Cisco may be starting to stabilize, but don't bet that any of its major competitors have lost their taste for Cisco blood, especially after Cisco spent so much of calendar 2011 playing defense. HP isn't the only company touting market share gains against Cisco, and smaller players, like Juniper and Brocade, continue to attack Cisco's bases with relish.

The other new factor? Thousands of Cisco employees -- no small number of them VP-level veterans -- have left the company following Cisco's restructuring. CRN interviews with sources inside Juniper, Huawei Symantec, HP, ShoreTel, Arista Networks and many others -- not to mention several VARs -- have all confirmed the same thing: hiring managers' desks are piled high with Cisco-dappled resumes. Will all that veteran, departed Cisco talent come back to haunt the networking king?

What's The Meat Behind 'Partner-Led'?

Cisco's corporate restructuring has meant a number of changes specific to its Worldwide Partner Organization (WWPO), including the appointments of new channel-facing executives, and departures of others.

It also meant the move to a new strategy called "partner-led," which will theoretically mean a greater emphasis on sales of Cisco products and services through channel partners in all but Cisco's most strategic accounts. Cisco partners, by and large, like the sound of partner-led but most have told CRN the strategy needs clarity: less concept, they say, more brass tacks, cleanly described sales engagement terms.

How Will Cisco's Channel Incentive Programs Evolve?

Cisco in mid-August confirmed changes to its major channel incentive programs, notably the Value Incentive Program (VIP), which in its 18th installment will see some fatter rewards for particular Cisco VARs, and the Teaming Incentive Program (SIP), which finally rolled out in the U.S. more than a year after its debut. The changes mean that one of partners' biggest fears heading into Cisco's fiscal 2012 -- that Cisco would make big cuts to the budget it allocates to the incentive programs -- appears to have been laid to rest.

But look closer, and there are more curious questions. Ricardo Moreno, Cisco's senior director, Strategy, Planning & Programs, Worldwide Channels, told CRN that new incentive programs related to Cisco's cloud programs and partner-led initiative are coming. Will those be sweet rewards for partners or end up creating headaches with too many incentive possibilities and too much complexity?

Is Cisco's Video Strategy Settled?

On one hand, video has never been a more pronounced piece of the Cisco portfolio. Cisco has named video as one of its five major focus areas for "the new Cisco," revenue on its collaboration unit grew 11 percent year-over-year in Q4, and Tandberg is now fully integrated into Cisco, more than a year after Cisco closed its $3.3 billion acquisition. The ordering problems that hampered the Tandberg integration earlier this year seem to have ebbed, according to VARs.

On the other hand, Cisco has cut a number of collaboration and video executives and seen several more walk out the door, and consolidated its service provider, enterprise and consumer video efforts under one executive, Marthin De Beer. There's also the small matters of two of its major consumer-facing video plays, the now-shuttered Flip and the marginalized Umi home telepresence. Video seems one area where Cisco partners seemingly don't need to worry, but it's also difficult to see things as "settled."

Will Cisco Refocus On Security?

Here's a stat that perhaps hasn't gotten much attention from Cisco observers as others have: Cisco's security product sales declined 8.4 percent from its fiscal 2010 to its fiscal 2011, and declined 21 percent (about $415 million this year versus $526 million last year) in its fiscal fourth quarter on a year-over-year basis.

In an interview with CRN earlier this year, Cisco Chairman and CEO John Chambers said that "security is our number one emphasis across the whole company, mainly because it's our customers' No. 1 issue" and discussed how many security challenges will be solved "in the network." After a year of security declines for Cisco -- and the fact that its ASA appliances were its hardest-hit products during Cisco's 2010 supply chain crisis -- many security-facing solution providers are wondering about Cisco's next move here.

Has Cisco's Acquisition Strategy Changed?

Up through the present, Cisco has been on an acquisitions streak that's gone largely unabated since 1993 -- indeed, it's one of the industry's most voracious acquirers.

What'll be interesting is whether this year's emphasis on Cisco's restructuring means any slowdown in acquisitions overall. Cisco bought three companies already this year, including cloud provisioning specialist NewScale, but it's vowed to become a simpler company, and less distracted by new "adjacencies" to which some acquisitions can provide it access.

Is Cisco Cius A Tablet Contender?

Cisco is looking to position Cius, its Android-based tablet, as the ultimate in business-centric endpoints for full-fledged enterprise unified communications systems.

Cisco finally launched the Cius globally at the end of July, and with volume discount programs, the Cius' price should be about $650, not including the additional price of its docking station. Is the market ready to embrace Cius, however, when so much of Cius' charm depends on its use with Cisco's own equipment and services, and there's so much competition in the tablet market in general? Cisco has been steadfast in positioning Cius as having business-centric features, such as on-board security, that separate it from Apple's iPad, but with iPad itself penetrating the enterprise and so much eardrum-shattering hype around tablets, Cisco may have a harder time directing the conversation than it first thought.

Is VCE Solid?

More than a few VARs have reported myriad problems and logistical headaches with VCE, the company that was established as a joint venture of Cisco and EMC with buy-in from VMware and Intel and designed to push the converged data center technologies and private cloud ambitions of all of those vendors.

Rob Lloyd, Cisco's executive vice president, worldwide operations, told CRN in July he is "personally involved" in making VCE simpler and easier for partners to work with, but many questions remain about the venture, which recently opened up to two-tier distribution with Ingram Micro, Arrow and Avnet. EMC recently spoke of "momentum" with VCE in EMC's most accurate 10-Q filing, but VCE has also lost millions amid ongoing whispers of internal restructuring.

With all the see-saw chatter, it's tough to get a read on how healthy the VCE venture really is.

Is Cisco Still Focused On Energy?

Because of all the cheerleading Cisco has done for the smart grid and energy management opportunities in accurate years, its recent decision to abandon its Network Building Mediator product has gotten more attention than Cisco probably hoped. Gary Moore, Cisco's executive vice president and COO, said on Cisco's Q4 earnings call that Cisco "will no longer be investing in premise energy management devices," a statement that lead to a round of speculation about Cisco's energy market ambitions.

Laura Ipsen, senior vice president and general manager, Cisco Connected Energy Group, said in a corporate blog post that Cisco's "commitment to the industry remains strong and our vision for energy management and Smart Grid has not changed." But for VARs and energy market specialists looking to Cisco as a potential thought leader for next-gen energy management technologies, the move leaves a sour aftertaste.

Cisco IOS XE Attacks: 7 Biggest Unanswered Questions

It’s among the most widespread cyberattack campaigns of the year, but much remains unknown about the vulnerability, the scope of the impacts and how many attackers are actually involved.

As security teams and IT admins close out a week of grappling with widespread attacks targeting Cisco Systems IOS XE customers, many key details about the situation remain elusive.

And until more information surfaces, experts say it’ll be tough to fully get a handle on the threat, which compromised tens of thousands of devices through exploitation of a critical vulnerability in the popular IOS XE networking software platform.

“In some ways, Cisco has been really amazing about sharing information,” said Caitlin Condon, head of vulnerability research at cybersecurity vendor Rapid7, in an interview.

For instance: Cisco provided a clear way to check for the presence of the attacker’s malicious implant, also known as a backdoor. And that is “one of the reasons why we understand prevalence as well as we do industry-wide right now,” Condon told CRN.

At the same time, there’s still a lot that’s unknown about the vulnerability, the scope of impacted devices, the motives behind the attacks and much more. “There’s quite a bit that is still either not known or not clear,” Condon said.

Cisco may hold the answers to some of the questions, while for other details it may take some time.

What we do know is that the Cisco IOS XE attacks are on track to be one of the most impactful attacks against IT hardware of the year, perhaps rivaling only the Barracuda Email Security Gateway attacks from mid-2023, Condon said.

With about two more months to go in 2023, “so far, I would say it’s those two,” she said of the Cisco and Barracuda attacks. And notably, both attacks targeted network hardware devices located on the edge of an organization’s IT setup.

CRN has reached out to Cisco for comment.

While examining what is and isn’t known about the IOS XE hacks, it’s worth underscoring an obvious point: Cisco is a huge company with a lot of technology under its roof.

“I think they’re probably running into what any large company runs into, where you don’t want to panic people,” Condon said. “But also, you do want to be transparent about, ‘Hey, there’s a problem here.’”

What follows are the seven biggest unanswered questions about the Cisco IOS XE attacks.

How soon could there be a patch?

First disclosed Oct. 16 by Cisco as a zero-day vulnerability, the privilege escalation flaw can enable a malicious actor to acquire complete control over a compromised device, the company has said. The vulnerability (tracked as CVE-2023-20198) has been awarded the maximum severity rating, 10.0 out of 10.0.

However, a patch to fix the vulnerability has yet to be made available. In a statement provided to CRN on Oct. 16, the tech giant said it is addressing the critical security issue “as a matter of top priority” and has been “working non-stop to provide a software fix.” An ETA on the patch has not been offered, though.

In one promising sign, researchers at cybersecurity firm Censys said Thursday that it appears the number of infected devices has peaked — at roughly 42,000— and the number of compromised devices is now declining as administrators take recommended measures.

“More than 5,400 Cisco XE devices have either removed their web interface from the internet, been taken offline, or had their configurations reset,” the researchers wrote. “However, Censys has identified 36,541 devices that remain online and compromised.”

How certain are we that the mitigations do the trick?

Cisco has said that an access restriction measure it has shared is effective at stopping exploits of the vulnerability in IOS XE.

The company has “high confidence” that “access lists applied to the HTTP Server feature to restrict access from untrusted hosts and networks are an effective mitigation,” Cisco said in an update to its advisory Oct. 17.

“I think a lot of people in these types of situations typically do want to be able to test for themselves: ‘Are the mitigation steps truly, completely effective?’” Condon said.

Security researchers would like to be able to check for additional attack vectors or potentially a modified attack chain that could still be effective, she said.

In other words, “are there other ways in?” Condon said. “I’m sure Cisco is doing their best. It seems like they’re trying to be transparent about this as quickly as they can. But if there were more information, we would be able to assess that.” And that would help with providing more information to defenders who are looking for guidance, she said.

Cyber defense teams are ultimately seeking “100 percent confirmation that we know what this is, we know how you mitigate it — and yes, we can confirm that [the mitigation] works,” Condon said. “That’s what they want to hear.”

What’s the full list of impacted devices?

Cisco has not provided the list of devices affected, meaning that any switch, router or WLC (Wireless LAN Controller) that’s running IOS XE and has the web user interface (UI) exposed to the internet is vulnerable, according to Mayuresh Dani, manager of threat research at cybersecurity firm Qualys.

That is a lengthy list, however. And so far, it’s not a list that actually has been released by Cisco.

Along with widely used enterprise switches in the Cisco Catalyst 9000 line, IOS XE also is used to run numerous other types of devices, many of which often run in edge environments that tend to get less attention than data center equipment. Those include branch routers, industrial routers and aggregation routers, as well as Catalyst 9100 access points and “IoT-ready” Catalyst 9800 wireless controllers.

But since there’s no comprehensive list of everything that runs IOS XE, many organizations are unclear on how, or even whether, they are impacted.

All in all, “it would be really helpful to have a list,” Condon said. “We can look at the datasheet and see these 20 things [that run IOS XE], but is that it? We don’t know.”

What is the full attack chain?

From what Cisco has disclosed so far, there’s not much that is known about the vulnerability itself, according to Condon.

For instance, “what exactly is the root cause? What does the attack chain look like?” she said. “The way they’ve described it is a little bit vague, which isn’t throwing shade at them. It just seems like maybe there’s still quite a bit about the exact attack chain that is not known. And that’s concerning.”

As one example, Cisco was upfront about the fact that there’s an additional mechanism involved in the attacks that they don’t fully understand yet. Cisco’s Talos threat intelligence team wrote in a post that a threat actor has been observed exploiting a previously patched vulnerability from 2021 (tracked at CVE-2021-1435) as part of installing a backdoor.

“We have also seen devices fully patched against CVE-2021-1435 getting the implant successfully installed through an as of yet undetermined mechanism,” the Talos blog said.

In other words, there’s some ambiguity in the attack chain that still needs to be cleared up.

For Condon, that raises questions such as, do you need both vulnerabilities? Or is one sufficient? “It sounds to me like they’re trying to be upfront about the fact that this is still an active investigation, and there’s stuff they don’t know.”

Can devices easily be re-compromised?

As part of the IOS XE attacks, the implants installed by threat actors do not have what’s known as “persistence” on a device, meaning that it’s eliminated when a device is rebooted.

However, the accounts created by attackers are not removed, raising the question of whether they may continue to have administrator access even after a reboot.

And because the full attack chain is still unknown, a big question is whether a device can easily be re-compromised, Condon said. “Can it be re-implanted?”

Is it just a single threat actor behind the attacks?

In the intrusion investigated by Rapid7 researchers, the team has identified some variation in the techniques used, Condon noted. Additionally, the researchers also determined that in a few cases, a customer environment was exploited multiple times in the same day. The findings were disclosed in a post from Condon on the Rapid7 blog earlier this week.

“We can’t say for sure that this might be more than one threat actor, but that’s something that’s on our mind,” she told CRN. “It’s possible.”

Who is behind the attacks and what’s their motive?

There’s been no attribution for the attacks so far and little evidence about what the threat actor, or threat actors, are trying to accomplish.

“I’m sure that eventually, whether it takes weeks or longer, we’re going to have a better understanding of, here’s what the full attack chain was and here’s the threat actor or actors this was attributed to. And here’s what we think they were after,” Condon said. “I’m sure we’re going to see country names in some of these articles.”

In all likelihood, “we’re going to learn that this is a skilled attacker who had orchestrated this action, whether it’s one attacker or multiple who were using similar techniques,” she said.

However, Condon noted, “at this point we don’t even know what what the full attack chain looks like. And there’s no patch. The message, I think, to administrators of these devices is, get them off the internet, reboot and then look for indicators of compromise.”

Exam Information

An test proctor will begin memorizing test instructions approximately 15 minutes before the test start time. Students must be in the test room with their test at this time. If taking the test on a laptop, it must be booted up and have passed the security check. Hand writers must not have a laptop with them in an test room, unless otherwise allowed according to the professor’s instructions. A student entering the test room after the proctor begins memorizing instructions will not receive additional time for booting up their laptop, passing the security check, and/or memorizing test instructions.

When instructed by the proctor, write your test number on the cover page of your exam, bluebooks, and any scratch paper you turn in as part of your exam. Handwritten test answers must be written in blue books in blue or black ink. Number the bluebooks you use (1 of 1, 1 of 2, 2 of 2, etc.). Proctors will allow time to read the professor’s instructions. Other than counting the number of pages of the exam, students are not permitted to turn the page of an test past the instructions page until the proctor instructs them to do so.

When taking a closed-book exam, no books, outlines, book bags, purses, or scratch paper (other than the scratch paper provided) may be at your seat during the exam. These items must be left outside of the test room or in the front or sides of the test room. NextGen Bar test MC Questions Only Require Takers To Spot Issues, And Not Apply the Rules

In law schools, generations of students have been taught the IRAC model to answer legal questions. First, students must spot the issue–what legal doctrine do the facts implicate? Second, students must state the rule–what particular legal precedent, statute, or principle governs this conflict? Third, students must then apply the rule to these facts–under a particular legal standard, how should the court rule? Fourth, students must state the conclusion–who wins, the plaintiff or the defendant?

Of course, there are many variations of IRAC, and invariably, many students stop using it rigidly at some point during the second year. But the basic process–applying a rule to particular facts is a cornerstone of legal education.

That background brings me to the NextGen bar exam. I have written about this new formulation of the multistate bar exam, which will launch in some states in 2026. Justice Jay Mitchell of the Alabama Supreme Court already expressed a concern that the National Conference of Bar Examiners (NCBE) is placing DEI concerns over competence. (Critics contend that the bar test is racist, and should be eliminated). I have another concern, which may be related–the NCBE seems to be making the test substantially easier.

The NCBE released a batch of questions to demonstrate how the NextGen test will function. The multiple choice questions reflect a new approach. Rather than forcing students to memorize particular rules, and then apply them, the new questions only ask students to spot the issue. The thinking is that practicing attorneys do not actually have to memorize particular rules, or even know how to apply them. So long as they can recognize what doctrine is implicated, a quick query on WestLaw, Lexis, and (lord help us) ChatGPT can locate the particular rule, and then the lawyer can figure out how to apply that rule to the facts (or just ask ChatGPT to do it). In short, bar examinees will not have to know the rule, apply the rule, or conclude the case. They only have to spot the issue. Only I, not RAC.

Consider this Criminal Procedure question:

You are a criminal defense lawyer representing a client who has been charged with fentanyl possession. The police found the fentanyl in the guest bedroom of the client's uncle's house when responding to a noise complaint at the house. Before entering the house, the officers knocked on the door. When the uncle answered the door, the officers asked if they could look inside the house, and the uncle agreed. The client did not live in the house and was not there at the time of the search. The client had stayed in the guest bedroom of the house two nights prior to the search. The uncle told the officers that the client was the last person to have slept in that room.

You are considering filing a motion to suppress the fentanyl under the Fourth Amendment.

Which of the following legal syllabus are the most important for you to research to determine the likelihood of success on a motion to suppress? Select two.

A. Consent search.
B. Exigent circumstances.
C. Hot pursuit.
D. Probable cause.
E.Reasonable suspicion.

The correct answer here is A (Consent Search) and F (Standing). Those are the legal syllabus that are "most important" to research. First, would the Uncle have authority to consent to the search? Second, would the criminal defendant have standing to challenge the Uncle's consent? Now the examinee does not actually have to answer whether the motion to suppress would be granted. Who cares if the Uncle could consent to the search? It doesn't matter if the defendant has standing. The test taker doesn't even have to know the relevant rules for consent searches and standing. All she has to do is spot the issue. I suppose the NCBE thinks that a first-year lawyer can simply enter "consent search" and "standing" into ChatGPT, knowing nothing more, and get the answer. I am not confident anyone can figure out these doctrines on the fly.

Let's try a Property question.

You are representing a client in a dispute with a neighbor. The client owns a single-family home with several acres of surrounding land. Recently, the client noticed that his neighbor had built a fence that extends onto the client's land. The client is unsure when the fence was built because that part of the client's land is obscured by large trees. When the client contacted the neighbor about the fence, the neighbor claimed that she did not know the location of the property line. The client has shown you a accurate survey of the property that confirms the encroachment and has asked you whether he has a claim against the neighbor.

Which of the following legal syllabus are the most important for you to research before advising the client? Select two.

A. Adverse possession.
B. Conversion.
C. Implied easement.
D. License.
E. Negligence.
F. Trespass.

The answers here are, once again, A (Adverse Possession) and F (Trespass). The question presented is whether the neighbor's fence encroaches (trespasses) on the client's property, and if there is an encroachment, has the neighbor acquired the right to do so through adverse possession. This question is complicated, because trees obscure the boundary (affecting the open and notorious prong), and the neighbor may not have even known if he was obtaining land through adverse possession (in the lingo, did he have the right claim of right?). I could see a student struggling with applying the rules to this question. But on the bar, an applicant only needs to spot the relevant doctrine, and pray they can figure stuff out when in practice.

I worry that these questions are far too simple. If the states end up adopting the NextGen exam, they should increase the cut score (the relevant percentage needed to pass the exam). Finally, I worry how this test will trickle down to law school pedagogy. Will professors shift their coverage to no longer require memorizing and applying the rules–only spotting issues? It's true that all lawyers have sophisticated tools at their disposal to research different topics. This new format seems to be a surrender to this technology–don't require students to do what they don't have to. I, for one, do not plan to change how I teach for this exam. And state supreme court justices should take a very long pause before adopting this new exam.

A mind-bending maths question designed for school children has left adults stumped - with some saying the puzzle is completely 'unsolvable'.

Do you remember sitting your maths exams at school and scratching your head at the strange real-life quiz questions you'd be presented with? The questions are designed to encourage students to use logic to pick out the important parts of the often long-winded story and then figure out which maths discipline they need to use to find the correct answer.

They're not always easy and for many of us, they will have been the least favourite part of any exam. And it's no different for kids today either, as one maths question designed for 11-year-old students has been leaving children and adults alike baffled as they struggle to find the answer.

The question came from a Chinese test paper that was designed for schoolchildren aged 11 in 2018. According to the BBC, a translation of the question asks: "If a ship had 26 sheep and 10 goats onboard, how old is the ship's captain?"

That's it. That's all the information you're given for this question - so try and answer it. Surely there must be some way to work it out, even though it certainly feels like you haven't been given enough details about the imaginary ship and its captain to truly reach a solution.

Other people who tried to work out the correct answer thought the same, and thanks to the South China Morning Post, we can even see some of the answers that clever students gave. One pupil argued: "The captain is 36 years old. He is quite narcissistic, so the number of animals corresponds to his age."

Another defied the question writers and refused to answer, as they said: "The number of the sheep and goats is irrelevant to the captain's age," and a third dejected student simply wrote: "The captain's age is ... I don't know. I can't solve this."

One answer from an adult on social media also tried to work the puzzle out using very sound logic, as they said: "In China, if you're driving a ship that cargo you need to have possessed a boat license for five years. The minimum age for getting a boat's license is 23, so he's at least 28."

But what is the correct answer? Well, there isn't one. Yep, that's right. Unfortunately, when we said this puzzle was "unsolvable", we meant it. As infuriating as it is, apparently the whole point of the question is that there's no way to work out the answer, and students will get the question right on their test if they explain they don't have enough information to provide a solution.

In a statement, Shunqing Education Department confirmed there was no answer, as they said: "The role of education is not to produce standardised spare parts ... Each answer can reflect a different personality. A question that can have different answers is a good question."
